Philadelphia partner Tamara Chasan was successful in obtaining summary judgment on behalf of her clients, the owners and managers of a large retail mall, in a premises liabillity case filed in Montgomery County. Judge Smythe dismissed the plaintiff’s case in its entirety after finding that the plaintiff had not met her burden of proof in proving negligence. Plaintiff had filed suit after a trip and fall on an escalator. Plaintiff’s allegations were that the mall had been negligent for allowing her to walk on a stopped escalator, and that the escalator began moving suddenly after she had begun her descent. She stumbled and fell from a height of several stairs and suffered a right ankle fracture. Plaintiff, a hair stylist, was also making a large wage loss claim.
