Auto Jumps Parking Barrier Striking Pedestrian in Restaurant Lot – Summary Judgment, Northeast PA

Our Scranton based colleague, Mark Sheridan, Esq., obtained summary judgment for his bar owner client resulting in the dismissal of a suit venued in Monroe County, PA.  Plaintiff pedestrian was walking on the sidewalk approaching the entrance of our client’s bar when she was struck by a vehicle which drove over the parking block in front of our client’s establishment resulting in serious leg injuries to plaintiff.  The trial court agreed with Mark’s contention that our client had not only complied with all applicable building code requirements, but that the event was too unusual and unpredictable as to require greater protection to customers walking on the sidewalk, such as the installation of vertical barriers.
