Central Pennsylvania partner, Steve Dugas, Esquire, successfully defended a contractor in a Blair County suit in which Plaintiff had fallen through an unsecured second story door in a house under construction while assisting the owners in painting the newly-installed drywall. Plaintiff suffered serious injuries, and was left with residual, permanent impairment from a Grade III shoulder separation in his dominant arm. A defense medical examination resulted in an opinion favorable to Plaintiff. The demand at the outset of trial was $130,000.00. Following three days in trial, in which no rebuttal of Plaintiff’s two medical witnesses was offered, the jury returned a verdict placing the majority of causal negligence on Plaintiff, resulting in the favorable defense verdict.
