Defense Verdict Lackawana County – Underground Utility Damage

Our partner, Mike Savitsky, secured a defense verdict for his construction company client who testified the job site was “ … lit up like a Christmas Tree …” identifying areas where our client was not permitted to excavate, however, there were no markings in the area where the loss occurred. PPL Electric Utilities Corporation (PPL) sued our client, Pioneer Construction (Pioneer) to recover damages to the PPL electrical line allegedly caused while Pioneer was excavating a job site. Pioneer had contacted the Pennsylvania One-Call service to confirm the site in question was clear for excavation and, as required by the Underground Utility Protection Line Act, PPL provided the approximate location of their utility wires. The court found the testimony of our staff and the evidence produced by Mike to be credible and rendered a verdict in favor of our client.
