Harrisburg partner, Stephen Banko, obtained a defense verdict on behalf of a GEICO insured in Cumberland, PA Court. The Defendant struck Plaintiff’s vehicle in the rear. Although there was only minor property damage, Plaintiff alleged that she suffered a shoulder and low back injury. She also alleged a severe headache resulting in nausea and vision disturbance. During her deposition, Plaintiff denied any recollection of prior similar treatment. Discovery revealed chiropractic treatment less than three weeks before the accident for complaints nearly identical to those made post accident. The jury deliberated for less than one half hour before returning a verdict finding that the Defendant’s negligence was not a factual cause of the injuries alleged by Plaintiff.
