In Somerset County, Summary Judgment was obtained for the client in a case involving a fall down an interior stairway, in the face of allegations that the accident resulted from slippery conditions due to water being tracked in from outside. Careful cross-examination of the Plaintiff and her witnesses brought out the lack of evidence of prior notice, and the likelihood that the water had been tracked in by Plaintiff herself.
In Mifflin County, the Plaintiff suffered serious back, hip and leg injuries as a result of the collapse of the deck she was standing on. After discovery was concluded, Summary Judgment was obtained for the client homeowner, on the basis of lack of any prior notice that the deck was unsound.
In Bedford County, a defense verdict on liability was obtained for the clients, who operated a nursery and landscaping business, even though the Plaintiff suffered serious and permanent damage to his right eye in a fall on their premises. Even though no defense medical testimony was produced, and Plaintiffs boarded in excess of $500,000.00 in lost earnings alone, Mr. Dugas successfully persuaded the jury that the condition of the premises was not defective or dangerous.
