Herbert Mondros focuses his practice on commercial and corporate civil litigation, and white-collar criminal defense litigation in Delaware state and federal courts, including the Court of Chancery, the Superior Court and the United States District Court. He has experience prosecuting and defending all manner of litigation including shareholders’ class and derivative actions, breach of fiduciary duty cases, preliminary injunctions, expedited corporate litigation, merger and acquisition litigation, claims under Directors and Officers insurance policies, demands to inspect corporate records under Section 220 of the Delaware General Corporation Law, commercial disputes, employment and labor matters, workers’ compensation, and all manner of complex tort cases.
Before joining Margolis Edelstein, Herb was a Trial Attorney with the Environmental Crimes Section of the Environment and Natural Resources Division of the United States Department of Justice, an Assistant United States Attorney for the Eastern District of Louisiana in New Orleans, where he was Chief Appellate Court Counsel, and a litigation associate in the Delaware office of Skadden Arps.
Herb has successfully mediated disputes on behalf of represented construction companies, door and window contractors, and commercial landlords, obtained a defense verdict at trial in a case against a home inspector involving claims moisture and mold intrusion, and obtained summary judgment in favor of his clients in a lawsuit alleging fraud. Herb is also part of a defense team that secured the release of a Delaware man wrongfully convicted of capital murder who spent more than 24 years on Delaware’s death row.
